Membership & Participation Agreement

Membership fees are specified at the time of enrollment. Payment may be made by cash, credit card, or check payable to ProElite Academy, LLC. Members paying by electronic funds transfer (EFT) authorize the billing company to draft all amounts owed, including any applicable late fees or service charges. An additional service fee will be charged for any payment returned for insufficient funds or any other reason. All billing disputes must be submitted in writing to the Academy's management within 120 days of the disputed charge. If any payment on a recurring subscription becomes more than ten days past due, a late fee will be assessed. Membership dues are paid in advance for future services.

Members have three (3) business days from the date of signing to cancel for a full refund. After the cancellation period, monthly subscriptions may be canceled by providing written notice to the Academy by the 15th of the month preceding the desired end date. Membership may also be terminated immediately in the event of permanent disability or death of the Academy Member, or extended due to a temporary disability supported by a physician's note.

Members may freeze their membership once per year for a minimum of one month and a maximum of three months. Freeze requests must be submitted in writing at least 10 days before the requested start date. A doctor's note is required for medical freezes, and all fees must be current. A monthly maintenance fee applies during the freeze period. Memberships automatically reactivate at the end of the freeze unless written cancellation notice is provided.

Participation in the Academy's programs involves inherent risks of injury to persons and property. These risks include but are not limited to injuries arising from use of facilities, locker rooms, and training areas; contact with communicable diseases; participation in supervised or unsupervised activities, programs, trips, classes, and events on or off Academy premises; personal training, instruction, and dietary recommendations; medical conditions such as heart attack, stroke, heat stress, sprains, fractures, and torn muscles or ligaments; accidents in or around the facility including parking areas; and theft or loss of personal property.

The parent or guardian represents that the Academy Member is physically and mentally fit to participate and will notify the Academy in writing of any change in the Academy Member's condition. The Academy strongly encourages a complete physical examination prior to beginning any exercise program.

By enrolling, the parent or guardian voluntarily assumes full responsibility for any risk of loss, property damage, or personal injury — including death — that may be sustained by the Academy Member, and releases ProElite Academy, LLC, its owners, officers, directors, employees, agents, and staff from any and all liability, claims, demands, and causes of action arising from participation in Academy activities. The parent or guardian further agrees to indemnify and hold harmless the Academy from any loss, liability, damage, or costs — including court costs and attorney fees — incurred due to the Academy Member's participation.

The Academy does not maintain medical or health insurance covering Academy Members. Parents and guardians are advised to review their personal insurance policies.

The Academy is not liable for any personal property that is damaged, lost, or stolen while on or around Academy premises, including vehicles and their contents. Academy Members and their families are liable for any damage caused to Academy facilities, equipment, or property.

The Academy may provide video and data tracking services through third-party providers. These services capture on-court activities including player movement, shot data, and video. By participating, members consent to the collection, use, and sharing of this data with other participants, the Academy, its technology partners, and affiliates. Data may be displayed on facility screens, leaderboards, and promotional materials. The Academy complies with the Children's Online Privacy Protection Act (COPPA), and parental consent for members under 13 is acknowledged through this agreement.

The Academy and its members may photograph or record activities, events, tournaments, and development sessions. Parents and guardians authorize the use of such photos, videos, and images on the Academy's website and promotional materials. Members may not use photographs or video taken on the premises for anything other than personal use without advance written approval.

All Academy Members, their families, and guests shall adhere to the following policies:

• Conduct — Respectful behavior is required at all times. Vulgar, threatening, harassing, or otherwise inappropriate conduct will not be tolerated.
• Attire — Proper athletic attire including shirts and shoes must be worn at all times.
• Weapons — No weapons of any kind are permitted on the premises.
• Food & Beverage — Outside food is not permitted. Clear, non-alcoholic liquids in closeable, unbreakable bottles are allowed. No alcohol or illegal substances on the premises.
• Tobacco & Smoking — No smoking, vaping, or tobacco products anywhere on Academy premises including outdoor areas.
• Cell Phones — Please use common courtesy when using cell phones in the facility.
• Illness — Members with a contagious illness may not enter the premises. Exposed lesions or rashes must be covered.
• Animals — No animals permitted except licensed service animals and on-duty law enforcement animals.
• Personal Belongings — Lock your vehicle and secure your belongings. The Academy is not responsible for lost, stolen, or damaged items.
• Injuries — Seek immediate medical assistance if injured. Notify an Academy employee to complete an incident report.
• Guests — Guests must present photo ID and sign a guest agreement. Members are responsible for guest conduct.
• Solicitation — Unauthorized solicitation of any kind is prohibited on the premises and at Academy events.
• Facility Access — The Academy reserves the right to close or restrict access to any area without advance notice for construction, maintenance, health, safety, or weather-related reasons.
• Equipment & Facilities — Members are responsible for any damage to Academy property, including broken sensors, lights, or equipment.

The Academy reserves the right to add, eliminate, or modify any program, equipment, or service at its sole discretion. The Academy also reserves the right to suspend or terminate any membership at any time, with a pro-rated refund of unused prepaid dues. State laws where the Academy facility is located govern the interpretation of this agreement. If any provision is held unenforceable, the remaining provisions remain in full effect.
